Terms of Service

HACCP Builder is operated by HACCP Builders, Inc. By using the software you agree to these terms.

Subscription terms

Service. HACCP Builder provides cloud software for food-safety records, plans and traceability to the facilities and organizations that subscribe.
Fees. Fees, billing and implementation are set in your order or proposal. There is no per-user charge.
Ending the subscription. You may end it whenever you choose by giving us 30 days’ written notice. The subscription then ends at the end of the billing period in which those 30 days run out. You pay for that whole period, and you keep full access until it ends.
Your data. You own all the records, documents and other data you put into HACCP Builder. You can download it at any time using the software’s download and print functions. You do the downloading; we do not prepare exports or copies for you. You keep full access, and can keep downloading, until your subscription ends; after it ends we may delete your data. You are responsible for keeping any records the law requires you to keep. We use your data only to provide the service and as the Privacy Policy describes, and we do not sell it.
Acceptable use. Use the software lawfully, keep your logins private, do not try to reach another customer’s data, and do not interfere with the service.
Your records. You are responsible for what you enter and for your own compliance with food-safety law. The software helps you keep records and build plans; it does not guarantee any inspection, audit or certification result.
Availability and support. We work to keep the service available and provide support as described in your order.
Liability. We work to keep HACCP Builder accurate and available, and we perform implementation and support with reasonable care. But the software, and the starter plans, procedures and other content that come with it, are provided “as is.” They are a starting point for you to review and adapt, and we do not promise they are error-free, always available, or right for every operation. We do not promise any inspection, audit or customer-review result. You and your facility remain responsible for food-safety decisions, for the safety of your products, and for any recall. To the extent the law allows, neither of us is liable to the other for indirect, incidental, special or consequential damages, or for lost profits, lost sales, lost product, recalls or business interruption. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose. Nothing here limits liability that the law does not allow to be limited.
Governing law. These terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Ramsey County, Minnesota, and each of us agrees to those courts.
Changes. We may update these terms and will post the new date.

Text message program: “HACCP Builder notifications”

What it is: work notifications from your facility’s HACCP Builder account: reminders to complete scheduled food-safety logs and check lists, and alerts when a record is out of range. No marketing texts.
Enrollment: your facility manager adds your mobile number; we text you once to ask you to reply YES; you are enrolled only after you reply YES. Agreeing to texts is optional.
Frequency: message frequency varies with your facility’s schedule.
Cost: message and data rates may apply. HACCP Builder does not charge you for the messages.
Cancel: reply STOP at any time. We will confirm once, and you will receive no more messages unless you enroll again. Reply START to rejoin.

Carriers: carriers are not liable for delayed or undelivered messages.
Privacy: see our Privacy Policy. Mobile numbers and SMS consent are not shared with third parties for marketing.
